Contracts often mandate mediation or arbitration as alternative dispute resolution (ADR) mechanisms. What do engineers need to know and how can they use ADR to their advantage? Do professional liability insurers offer financial incentives for mediation? Is arbitration still alive? Are owners still cheering for ADR? Kevin Sido, Esq. will address these questions and more as a featured speaker at the Illinois Society of Professional Engineers (ISPE) Annual Convention on July 25 -26, 2013.  He will discuss what Illinois engineers need to know about mediation and arbitration and why ADR is so important for an efficient and cost-effective resolution of construction disputes. Owner-engineer agreements often require mediation before a demand for arbitration is filed or litigation commences. More than 200 are expected to attend this annual two day conference in Lisle, Illinois. Mr. Sido is a senior mediator and arbitrator, working exclusively with ADR Systems. ADR Systems is a leading provider of mediation, arbitration, and other dispute resolution services. For Mr. Sido’s bio, click here. Judge McNamara was instrumental in settling a very difficult and contentious case. Although I disagreed with certain (not all) of Judge McNamara’s legal positions, she expressed her opinions in a way that got my clients to focus on other things besides their dissatisfaction. There was nothing but bad blood between the parties, and Judge McNamara appealed to the better nature of both sides to resolve their differences. These intangibles, plus her experience, social skills, and ability to translate the process to the parties in an understandable way from a judge’s perspective, were all instrumental in settling the case.
