ADR News: $3.5M Settlement

ADR Systems congratulates Hon. Michael J. Hogan (Ret.) for his recent settlement of a 10-year-old product liability and medical malpractice case involving the death of a three-year-old child.

The events of the case took place in 1998 when a fire occurred in the house of the plaintiff. As a result of the fire, the plaintiff’s three-year-old daughter was hospitalized to be treated for smoke inhalation, where the child subsequently died.

The plaintiff claimed that the fire started inadvertently, after her second daughter was playing with a lighter that was improperly designed without a child-resistant safety feature. In addition, the lawsuit contended that the plaintiff’s three-year-old daughter accidentally received an overdose of potassium chloride while being treated for smoke inhalation at the hospital.

The plaintiff was represented by Michael K. Demetrio, Edward G. Willer and Margaret M. Power, all of Corboy & Demetrio.

After 10 years in litigation, including the case going to the IL Supreme Court, the case was settled for $3,500,000 through non-binding mediation at ADR Systems with Hon. Michael J. Hogan (Ret.) serving as mediator.
